Subject:        RESOLUTION.             

 

 

I am to state that the Provincial Assembly of Sindh in its sitting held on Monday, the 02nd September, 2024 has unanimously passed the following Resolution moved by Mr. Zia-ul-Hassan, Minister for Law, Parliamentary Affairs & Criminal Prosecution and Home, Sindh: 

 

 

WHEREAS prior to Eighteenth Amendment in the Constitution of Islamic Republic of Pakistan, 1973, the subject “Explosives” was regulated by the Federal Government by the Explosives Act, 1884;

 

 

AND WHEREAS in consequence of the 18th Amendment in the Constitution of Pakistan, 1973, the subject “explosives” falls within the provincial legislative field and the Provincial Assembly of Sindh in exercise of its powers under paragraph (c) of Article 142 of the Constitution, enacted a law titled “the Sindh Explosives Act, 2019”;

 

 

AND WHEREAS the Federal Government has approached the Provincial Government and has conveyed its apprehension that owing to loopholes in the existing rules, regulations and gaps in implementation, pilferage in domestically manufactured explosives, supply chain has increased; and that the pilferage may be exploited by the terrorists by using the same in terrorist activities and thus the pilferage is attributed to complicated and multifarious issues involved in licensing, manufacturing, transportation, storage and commercial usage;

 

 

AND WHEREAS the Federal Government has drafted a National Explosives Policy to monitor and regulate the subject matter at Federal level but to approve the National Explosives Policy, it is required that the subject “explosives” may be transferred back to the Federation and thus has requested to initiate the transfer the subject “explosives” to the Federation for formation and subsequent implementation of the National Explosives Policy and to make amendments in the Explosives Act, 1884 at Federal level.

 

 

AND WHEREAS after 18th Amendment in the Constitution, the subject “explosives” falls within the provincial legislative field and the Parliament can enact a law if one or more Provincial Assemblies pass Resolution to authorize the Parliament under Article 144 of the Constitution of the Islamic Republic of Pakistan, 1973;

 

 

AND WHEREAS keeping in view the apprehension and request of the Federal Government, it is expedient in the public interest to authorize the Parliament to enact/amend the law;

 

 

NOW, THEREFORE, the Provincial Assembly of Sindh by this Resolution hereby authorizes the Parliament to enact / amend the law by the Parliament to regulate the subject “explosives” at Federal level.
